1. Application and reservations
- These general terms and conditions apply to all reservations and agreements relating to JKmoulin, 17 Route de St Roch, 13520 Paradou, France , regardless of your reference to any terms and conditions of your own or others. Deviations from these terms and conditions are only valid if made in writing.
- Your reservation is only valid when it is confirmed with an advance invoice of 50% and this advance payment has been paid in full: the reservation is only valid when both conditions are met.
- If you have not received our confirmation within a week, please contact us immediately. Please also check the confirmation for possible errors. You cannot claim any errors that you have not checked and reported immediately upon receipt of the document.
- All our agreements are of short duration.
2. Payment
Payment is subject to the following conditions :
- A 50% deposit must be paid at the time of booking: this payment can be made by bank transfer or via the site www.jkmoulinparadou.com.
- The balance of the second 50% plus any extra bookings (massages,… …) will be sent to you 45 days before your arrival and must be paid immediately.
- If your booking is made within 45 days of your arrival, 100% is payable immediately.
- Payments should be made to the IBAN Number:
FR7610071130000000202089828 mentioning the invoice number. - By paying the deposit or balance you confirm that you have read and are agreeing to these General Conditions. The rental ends automatically after the expiry of the agreed period.
- In the event of late payment, we reserve the right to cancel your reservation and dissolve the agreement.
3. Security deposit
- If you rent JKmoulin exclusively and in full, we will add to the final invoice, which you will receive 45 days before your arrival, a guarantee deposit of €2500, which is intended to cover damages in the broadest sense of the word, which we may suffer in the event of non-compliance with the tenant’s obligations as a good tenant and those accompanying the tenant. In addition, at the time of check-out, the refund of the deposit may be reduced by costs incurred during the stay.
- The deposit or the balance thereof, after settlement of damages or costs incurred, will be refunded within 14 days of departure to an account to be specified by the tenant. Any (further) claims for compensation shall not be cancelled by this refund.
- If, in the event of any damage, it appears that the deposit is not sufficient to compensate the full damage, we reserve the right to hold you liable for this remaining damage.
4. Amendments
- If the tenant, after a valid reservation, wishes to make changes to the booking, the landlord is not obliged to comply.
- If the tenant, after a valid reservation, wishes to change the period of stay to a different or non-consecutive/connected period of stay; the cancellation conditions as stated in article 5 of these rental conditions apply.
5. Cancellations
Cancellation by the tenant must always be done in writing by email to hello@jkmoulinparadou.com.
The following conditions apply:
- In case of cancellation after the reservation and up to 46 days before arrival: you are entitled to a refund of your 50% deposit.
- In case of cancellation from 45 to 30 days before arrival: the landlord is entitled to 50% of the total amount of the reservation.
- In case of cancellation within 30 days of arrival: the landlord is entitled to 100% of the booking + additional costs for extra’s that can no longer be cancelled.
- If you have not cancelled but do not show up within 24 hours of the agreed arrival date, without further notice, this will be considered a cancellation and 100% of the rental will be due as well as any additional bookings/ extra’s that have been made.
In case of cancellation by the landlord, any deposits already paid will be refunded.
6. Check in/check out
The following rules apply to reservations/ stay :
- Check in after 17.00h on the day of arrival
- Check out before 10.00h on the day of departure
- Exceptions can only be made in writing
- If you are allowed to leave your luggage after 10.00h or to put it down before 17.00h, this does not mean that you can enter the premises again without appointment or explicit permission
- JKmoulin is a non-smoking building: smoking is only allowed outside without disturbing other tenants
- Open fires are not allowed outside
- Pets are not allowed
- The rental includes cleaning before and after of the room, bed and linen
- Stay by the number of persons as agreed: the landlord reserves the right to refuse or charge for extra people
7. Force majeure
Force majeure on the part of JKmoulin exists if the execution of the agreement, in whole or in part, temporarily or otherwise, is prevented by circumstances beyond our control, including but not limited to danger of war, blockades, strikes, floods, electricity failures and other disruptions or events.
8. Liability/ Complaints/ Damage
- The tenants and the other users are fully and each jointly and seperately liable for all damage caused to the house or its contents during the respective rental period, unless the tenant can make it plausible that the damage cannot be attributed to him. We recommend inspecting everything carefully on arrival and reporting any damage or defects immediately.
- We accept no liability for theft, loss or damage of or to property, of whatever nature, during or as a result of the stay.
- We accept no liability due to excessive nuisance from neighbours, in case of failure or non-functioning of technical equipment, utilities, non or partial functioning of the internet or TV.
9. Applicable law
French law is exclusively applicable to all our conditions from the rental agreement/house rules as well as any disputes.
